Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Leading Agents real estate CRM and related services (the "Service") offered by Leading Agents at leadingagents.com.au and associated subdomains. The Service is intended for businesses and professionals in the real estate sector ("B2B"). By accessing or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the organisation you represent.
1. Acceptance of terms
If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; we will indicate the date of the latest revision at the top of this page. Your continued use after changes constitutes acceptance of the updated Terms, except where prohibited by law. Additional terms (for example an order form or data processing addendum) may apply between you and us or your agency.
2. Eligibility and account setup
You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms or pose a security risk.
3. User responsibilities
You agree to:
- Use the Service only for lawful purposes and in compliance with applicable real estate, privacy, and marketing laws;
- Obtain any consents and rights required to upload, process, or share personal information about your clients and contacts through the Service;
- Not misuse the Service (including attempting to gain unauthorised access, interfere with other users, or overload our systems);
- Not use the Service to send spam or misleading communications;
- Ensure that your users comply with these Terms.
4. Third-party integrations
The Service may integrate with third-party products and APIs. Your use of those integrations is subject to their respective terms and policies in addition to these Terms.
Google Workspace and Google APIs: If you connect Google Calendar, Gmail-related features, or other Google services, your use of Google user data is also subject to Google's terms and the Google API Services User Data Policy. You authorise us only to access data for the features you enable. You may disconnect integrations at any time subject to product functionality.
DocuSign: Electronic signature features may be provided via DocuSign or compatible providers. Your use of DocuSign is subject to DocuSign's terms and conditions. We are not responsible for DocuSign's platform availability or changes to their service.
We are not responsible for third-party services' acts or omissions; integrations are provided "as available" and may change if providers modify their APIs.
5. Intellectual property
The Service, including its software, branding, and documentation, is owned by Leading Agents or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes. You retain ownership of content you submit; you grant us a licence to host, process, and display that content as needed to provide the Service.
6. Confidentiality
Each party will protect the other's confidential information with reasonable care and use it only in connection with the Service, except as required by law.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by applicable law, Leading Agents and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for all claims arising out of or related to the Service shall not exceed the greater of (a) the fees you paid us for the Service in the twelve (12) months before the claim or (b) one hundred Australian dollars (AUD $100), except where liability cannot be limited by law (including under the Australian Consumer Law, where applicable).
9. Indemnity
You will indemnify and hold harmless Leading Agents and its affiliates from claims, damages, and costs (including reasonable legal fees) arising from your content, your use of the Service in breach of these Terms, or your violation of applicable law or third-party rights.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access to the Service for breach of these Terms, non-payment (if applicable), legal or security reasons, or discontinuation of the Service, subject to any notice period in a separate agreement. Provisions that by their nature should survive (including liability limitations, indemnity, and intellectual property) will survive termination.
11. Australian law
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales shall have non-exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
